There are more and more cities in the world in which the authorities require that people who have a pet must register it and place an identification microchip in the animal; which contains relevant information about the dog and its guardian. And regardless of who is the dog’s favorite caregiver or even who it lives with, the person whose name appears on the microchip is considered the owner of a dog.

This microchip is being of great help in many aspects. Thanks to this technology, a dog is largely prevented from being lost or stolen. It also prevents the abandonment of dogs and indicates who is responsible for it in case of damage to third parties, since it indicates who is its legal owner.

Can you put a dog’s chip in the name of two people?

The information of a microchip is associated with a single dog and a single caregiver of legal age, therefore, there cannot be a chip in the name of more than one person or a child. This means that, when it comes to answering for the dog, only one person is considered responsible and owner.

That a single person is considered a legal owner of a dog can be a problem in certain situations.

For example, it is increasingly common for couples without children to decide to acquire a dog to provide all their love and care. However, it is also very common for dog custody issues to occur when a couple decides to separate.

If the two claim the dog and fail to reach an agreement, the case ends up in court; and sometimes the judge decides to give custody of the dog to the person whose data does NOT appear on the microchip. However, in many cities, a dog is not legally recognized as a living being, but as a property; therefore, the dog must be handed over to the person whose data appears on the microchip, although; sometimes, this decision is not the most convenient for the dog’s well-being.

Who keeps the dog in case of divorce?

Currently, in some countries such as Spain, the possibility of making certain modifications to its civil code to recognize dogs and other pets as beings that feel is being studied. This opens up the possibility for the judges to analyze in more detail the situation of each dog, and decide what is best for the animal; so they can issue judgments on the custody of the pet more just or equitable, prioritizing the well-being of our furry friends.
